The Taliban\u2019s Ministry of Justice has announced that the law titled “Review of Movable and Immovable Properties of Absent Persons” has been promulgated and become effective following approval by the leadership of the ministry, published in the official gazette number 1491. According to this announcement, the implementation of the law has been entrusted to the Office for Reviewing the Properties of Absent Persons, operating under the military deputy of the Supreme Court.<\/p>\n
The law consists of an introduction, four chapters, four sections, and 31 articles. It specifies how the properties of absent and missing persons are to be managed, how these assets are to be protected, and the procedures for transferring them to the state treasury. As stated in the law, any property that is not in the possession of a specific individual and is at risk of being seized will be protected by the Taliban administration.<\/p>\n
The Ministry of Justice added that according to Article 9 of the law, whenever the owner, heir, or legal representative of the protected properties appears and requests delivery, the relevant office is obliged to hand over the property to them based on a judge\u2019s order. Furthermore, if the owner has died and there is no heir or legal claimant, their assets will be transferred to the state treasury.<\/p>\n
The law also regulates issues such as the registration, leasing, and sale of certain movable properties; the conditions for the legal representatives of absent persons; the validity of foreign powers of attorney; and the procedures for delivering collected revenues to the rightful owners.<\/p>\n
According to Article 29, the Office for Reviewing the Properties of Absent Persons is required to return houses that have been seized unlawfully\u2014whether after the Taliban came to power or before\u2014by individuals or official and unofficial bodies, to the original owners or their legal representatives based on a judge\u2019s ruling.<\/p>\n
While the Taliban administration states that the objective of this law is to prevent seizure and to protect the properties of absent persons, the concentration of powers within structures affiliated with this administration, along with a lack of transparency in judicial procedures, has raised concerns among some citizens about the protection of property rights and fair access to the courts.<\/p>\n","protected":false},"excerpt":{"rendered":"
