UN experts, including Richard Bennett, the UN Special Rapporteur on the situation of human rights in Afghanistan, have formally urged the Taliban administration to repeal its “Penal Code of Courts.” They have described the document as a serious threat to the human rights situation in the country and warned about its consequences.<\/p>\n
In a letter published on Thursday, April 16, the experts emphasized that this penal code exacerbates the systematic weakening of human rights protections in Afghanistan. They believe that implementing such regulations could impose broader restrictions on citizens\u2019 fundamental freedoms.<\/p>\n
The letter raises concerns over extrajudicial executions, limitations on the freedom of peaceful assembly, the erosion of judicial independence and lawyers\u2019 rights, the situation of minorities, and the lack of protection against violence and discrimination based on sexual orientation and gender identity. It also highlights contemporary forms of slavery, including their causes and consequences, as well as the risks of torture and other cruel, inhuman, or degrading treatment or punishment.<\/p>\n
Besides requesting the repeal of the penal code, the UN experts have called on the Taliban to clarify the timing, rationale, and necessity behind its enactment. They have also submitted a series of questions and recommendations regarding this matter.<\/p>\n
The Taliban administration published its “Penal Code of Courts” last year. According to experts’ assessments, the document recognizes slavery, violates the rights of religious minorities, and divides society into different classes.
